Accident benefits are the no-fault portion of Ontario auto insurance, governed by the Statutory Accident Benefits Schedule. They pay for medical and rehabilitation treatment, income replacement, attendant care, and, in serious cases, benefits at the catastrophic level.

The forms that start the clock

The OCF-1 Application for Accident Benefits is generally due within thirty days of receiving the package from your insurer. The OCF-2 comes from your employer, the OCF-3 Disability Certificate from your health practitioner. Late or inconsistent forms are the most common reason benefits stall.

When a treatment plan is denied

A denial is not the end of the process. Insurer examinations can be challenged with your own treating evidence, and disputes are heard by the Licence Appeal Tribunal. Applications to the Tribunal are subject to a two-year limitation running from the denial, so denial letters should be reviewed as they arrive rather than collected.

Can I claim accident benefits if the accident was my fault?

Yes. Accident benefits are payable regardless of fault, subject to limited exclusions such as operating a vehicle without insurance.

I was a pedestrian or cyclist. Am I covered?

Generally yes, if a motor vehicle was involved. Coverage may come from your own policy, a household policy, or the insurer of the vehicle involved.
