Boundaries and encroachments

A current survey is usually the starting evidence. Where a structure has crossed a line for a long period, prescriptive rights and adverse possession principles may apply differently depending on whether the land is registered under the Land Titles system.

Co-ownership deadlock

Where co-owners cannot agree, the Partition Act allows an application to force a sale or division. The prospect of that application alone often produces a negotiated result.

Start with a survey and a written notice. Litigation is available, but boundary matters resolve most cheaply through a negotiated agreement or a registered easement.
